Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Information Amendment (Vaccination Reporting) Principles 2021

  • Enables the Secretary to make information public about the numbers of service staff and care recipients at a particular aged care service who have received certain vaccinations.

Migration Amendment (Temporary Sponsored Parent Visas) Regulations 2021

  • Makes concessions for certain visa holders affected by COVID-19 travel restrictions.

Public Health (Jervis Bay Territory) Emergency Declaration Further Extension (No. 3) 2021

  • Further extends the period during which the Public Health (Jervis Bay Territory) Emergency Declaration 2020 is in force by a period of 90 days.

Therapeutic Goods Legislation Amendment (2021 Measures No. 2) Regulations 2021

  • Supports the timely availability of new COVID-19 vaccines and treatments in Australia, among other things.

Liquor (COVID-19 Emergency Response - Permit Fee Waiver) Declaration 2021 (No 2)

  • Waives the fee for an application for a commercial permit from 1 July 2021 until 31 August 2021 for liquor licensees with an on licence, and waives the fee for an application to amend a permit from 1 July 2021 until 31 August 2021 for commercial and non-commercial permit holders.

Public Health (COVID-19 Areas of Concern) Notice 2021 (No 184)

  • Declares certain areas to be COVID-19 affected areas, places of high concern, and places of concern.

Community Land Management Amendment (COVID-19) Regulation (No 2) 2021

  • Allows altered arrangements for convening, and voting at, meetings of an association or its executive committee, and allows instruments and documents, instead of being affixed with a seal of an association in the presence of certain persons, to be signed, and the signatures witnessed, by those persons.

Public Health Amendment (COVID-19 Penalty Notice Offences) Regulation 2021

  • Amends the Public Health Regulation 2012 in relation to penalty notices for failing to comply with a direction of the Minister for Health and Medical Research under the Public Health Act 2010, Section 7 in relation to the COVID-19 pandemic.

Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Amendment (No 12) Order 2021

  • Restricts visitors at a place of residence except in certain circumstances.  

Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Amendment (No 13) Order 2021

  • Requires a person who is not required to wear a fitted face covering under the Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Order 2021 to carry relevant evidence and to produce the evidence for inspection by, and give a copy to, a police officer upon request.

Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Amendment (No 14) Order 2021

  • Extends, to the local government areas of Cumberland and the City of Blacktown, the prohibition on persons, other than authorised workers, leaving the local government area for the purposes of work.

Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Amendment (No 15) Order 2021

  • Makes miscellaneous minor amendments to the Public Health (COVID-19 Temporary Movement and Gathering Restrictions) Order 2021.

Strata Schemes Management Amendment (COVID-19) Regulation (No 2) 2021

  • Allows for altered arrangements for convening, and voting at, meetings of an owners corporation or a strata committee, and allows instruments and documents, instead of being affixed with the seal of an owners corporation in the presence of certain persons, to be signed, and the signatures to be witnessed, by those persons.

COVID-19 Directions (No. 34) 2021 - Day 3 Post-Quarantine Testing Requirement

  • Requires persons who were quarantined in a hotel or facility managed by a State or another Territory and who enter the Territory within 4 days of exiting that quarantine to submit to a COVID-19 testing procedure on the 3rd day after exiting quarantine or as soon as possible after that day, and quarantine as required if testing is not performed.

COVID-19 Directions (No. 37) 2021 - Amendment to COVID-19 Directions (No. 1) 2021

  • Allows police offers and authorised officers to request an explanation for why a person is not wearing a mask, and to require certain evidence to be produced.

Border Restrictions Direction (No. 30)

  • Restricts entry into Queensland for persons who have been in COVID-19 hotspots and requires certain persons to undergo COVID-19 testing or quarantine, among other things.

Declared Hotspots Direction

  • Declares the remaining 91 LGA’s and 2 unincorporated areas of NSW as COVID-19 hotspots, identifies hotspots for Public Health Direction - Border Restrictions Direction (No. 27) or its successor, and identifies COVID-19 hotspots for other public health directions about the movement of people to or from COVID-19 hotspots.

Disability Accommodation Services Direction (No.21)

  • Sets the requirements for all shared disability accommodation services, manages access to non-restricted shared disability accommodation services, sets requirements for restricted shared disability services and requires operators of shared disability accommodation services to make all reasonable efforts to electronically collect contact information about all visitors and contractors, among other things.

Hospital Entry Direction (No. 2)

  • Limits access to all hospitals and requires operators of a hospital to make all reasonable efforts to electronically collect contact information about all visitors to a hospital, among other things.

Queensland COVID-19 Restricted Areas (No. 18)

  • Lists no Local Government Areas as Queensland COVID-19 restricted areas for the Public Health Direction - Residential Aged Care Direction (No. 3) or its successors, Public Health Direction - Disability Accommodation Services Direction (No. 21) or its successors, or the Public Health Direction - Hospital Entry Direction (No. 2) or its successors.

Queensland Health Residential Aged Care Facilities (COVID-19 Vaccination) Direction

  • Sets out the COVID-19 vaccination requirements for employees and for Queensland Health.

Residential Aged Care Direction (No.3)

  • Limits entry to residential aged care facilities, requires operators of a residential aged care facility to develop a Workforce Management Plan, and sets the requirements for PPE and electronic collection of contact information, among other things.

Restrictions for Impacted Areas Direction (No. 10)

  • Restricts the number of people who may gather in homes or public places in an impacted area (impacted areas are Brisbane City Council, Moreton Bay Regional Council, Ipswich City Council, Logan City Council, Redland City Council, Sunshine Coast Regional Council, Gold Coast City Council, Noosa Shire Council, Somerset Regional Council, Lockyer Valley Regional Council, and Scenic Rim Regional Council) and restricts how certain businesses must operate.

Restrictions on Businesses, Activities and Undertakings Direction (No. 23)

  • Sets the occupant density for restricted businesses, activities or undertakings and the requirements for the collection of contact information using Check In Qld app, among other things.

Approval of the Governor of Extension of a Major Emergency Declaration

  • Extends the Major Emergency Declaration made on 22 March 2020 for a period of 28 days commencing on 24 July 2021.

Emergency Management (Activities - General No 3) (COVID-19) Direction 2021

  • Puts in place a range of basic control measures that will apply generally to public activities and gatherings while the Major Emergency Declaration remains in force, and allows for other levels of control measure to be put in place from time to time by associated directions.

Emergency Management (Activities - Associated Direction No 6) (COVID-19) Direction 2021

  • Declares the whole of the State to be a declared area that is subject to level 3 restrictions.

Emergency Management (COVID-19) (Exposure Site Requirements No 2) Direction 2021

  • Imposes testing and isolation requirements on people who have been present at an exposure site (and in some cases their household members) during an exposure period, for 14 days commencing on the person’s last exposure date, and clarifies testing and isolation requirements for people who were subject to the testing and isolation requirements under the Emergency Management (COVID-19) (Testing Requirements No 1) Direction 2021.

Emergency Management (COVID-19) (Supervised Quarantine No 10) (COVID-19) Direction 2021

  • Specifies testing and vaccination requirements, and prohibitions, for certain employees and contractors, among other things.

Emergency Management (Cross Border Travel - Associated Direction No 34) (COVID-19) Direction 2021

  • Applies cross border requirements to all overseas arrivals and certain interstate arrivals from ACT, NSW, Queensland and Victoria, and declares certain restricted zones, among other things.



Direction Under Section 16 - Contact Tracing - No. 7

  • Requires certain persons and premises to provide or keep specified information, to use the Check in Tas app and to display QR codes compatible with the Check in TAS app, among other things.


Care Facilities Directions (No. 38)

  • Provides for restricted access to care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11.59 pm 27 July 2021.

Hospital Visitor Directions (No. 34)

  • Prohibits non-essential visits and access to hospitals in order to limit the spread of COVID-19 - came into force at 11.59 pm 27 July 2021.

Occupational Health and Safety (COVID-19 Incident Notification) Regulations 2021

  • Improves the information available to the Authority to reduce the risks to health and safety in the workplace arising from COVID-19, and prescribes requirements for employers or self-employed persons to notify the Authority immediately after becoming aware that an employee or independent contractor has been diagnosed with the disease COVID-19.

Restricted Activity Directions (Victoria) (No. 20)

  • Restricts the operation of certain businesses and undertakings in the State of Victoria to address the serious public health risk posed by COVID-19 - came into force at 11.59 pm 27 July 2021.

Stay Safe Directions (Victoria) (No. 26)

  • Requires persons to limit their interactions with others by restricting private and public gatherings, and to carry and wear face coverings at all times except in certain circumstances - came into force at 11.59 pm 27 July 2021.

Victorian Border Crossing Permit Directions (No. 24)

  • Provides a ‘traffic light’ border crossing scheme for persons seeking to enter Victoria from any other State or Territory in Australia, or after entering Australia from a Green Zone Country - came into force at 9:00 pm on 23 July 2021.

Workplace (Additional Industry Obligations) Directions (No. 34)

  • Establishes additional specific obligations on employers and workers in specific industries in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm 27 July 2021.

Workplace Directions (No. 39)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces and establishes more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm 27 July 2021.

Controlled Border for Western Australia Amendment Directions (No 35)

  • Amends the Controlled Border for Western Australia Directions by changing the definition of 'Low Risk Jurisdiction' to include the Australian Capital Territory, and 'Outbreak Jurisdiction' to include NSW, QLD, SA and Victoria, among other things.


COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order (No 7) 2021

  • Amends Clause 8B of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 to provide that only QFT persons may arrive in NZ on an aircraft undertaking a QFT flight, to provide that a failure to comply with this requirement is an infringement offence, to require persons arriving in NZ on an aircraft undertaking a QFT flight to provide certain evidence to relevant officials as required, and to extend the definition of relevant official to include a Customs officer.

COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order (No 8) 2021

  • Ensures that diplomats, consular officials, and certain New Zealand Defence Force members who are exempt from Clause 8 of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 (general obligations on persons arriving in New Zealand by air) are also exempt from certain other obligations imposed on QFT carriers and persons on QFT flights.

COVID-19 Public Health Response (Exemptions and Conditions for Quarantine-free Travel) Amendment Notice (No 14) 2021

  • Amends the COVID-19 Public Health Response (Exemptions and Conditions for Quarantine-free Travel) Notice 2021 to extend certain conditions applicable to persons exempt from isolation and quarantine requirements under the COVID-19 Public Health Response (Air Border) Order (No 2) 2020, to require that persons have not been in additional locations in Australia, during specified dates and times, among other things.
